Planning & Development

 

OUR APPROACH

The current planning controls that apply to the Club’s landholdings are established under the Ku-ring-gai Local Environmental Plan (Local Centres) 2012 (hereafter referred to as KLEP 2012).

The KLEP 2012 establishes the range of land uses that can be built on the site and prescribes the maximum floor space ratio and height controls. The site is zone B2 Local Centres under the LEP and ‘Registered Clubs’ and ‘Shop Top Housing’ are permissible uses with the consent of the Council.

When Hyecorp and the Club commenced this project back in 2016 we recognised that we would need to advance an application to amend the height control that applied to the land under the KLEP 2012. In this regard the existing controls allow for a 6 storey building while our development vision for the New Rose was based on a 7 storey building.

To facilitate the timely delivery of the new club facility we made the decision to advance the project under multiple applications. This would enable us to achieve development approval for the majority of the building (the basement car parking, new club facility and 5 levels of residential apartments) and to commence construction of the Club without having to wait for the KLEP 2012 height control to be amended.

Accordingly, when we first consulted with the local community on this project in 2018 we presented our architectural plans for the 7 storey building because we wanted to share with the community our holistic development vision.

At this time we also identified that the planning process for this project would involve 3 separate applications being made to Ku-ring-gai Council and the NSW Department of Planning Industry and Environment. These were:

  • Application 1 involving a development application seeking approval for the new club, basement car parking and the development of 6 storeys of shop top housing.

  • Application 2 involving a Planning Proposal requesting an amendment to the height controls that relates to the site under KLEP 2012 to enable one additional storey of shop top housing to be developed.

  • Application 3 will proceed once the height control that applies to the site has been amended. This application will seek approval for alterations and additions to Application 1 being one additional storey of residential apartments, which would be the 7th storey to the approved building.

CURRENT PLANNING AND DEVELOPMENT STATUS

The current status of the planning applications for the New Rose project is set out below:

Application 1 for Stage 1 of the New Rose

  • This Development Application is officially referred to as DA 0134/18 and was approved by the Sydney North Planning Panel on the 2nd September 2020. The consent enables the following work to be undertaken on site:

    • The demolition of existing structures being the existing Memorial Club building and the adjacent retail shopfront;

    • The construction of a new mixed use building comprising of a new ground floor Memorial Club (registered Club) with 33 x 1, 2 and 3 bedroom residential apartments above over levels 1 to 5;

    • A roof top communal open space terrace; and

    • 3 levels of basement car parking including loading dock and waste collection area.

Application 2 seeking the height amendment to the KLEP 2012

  • In NSW the planning process that is followed when an amendment is requested to be made to a development standard in a local environmental plan is called the Gateway Plan Making Process and the application that is made seeking the amendment is called a Planning Proposal.

  • Hyecorp and the Club lodged the Planning Proposal with Ku-ring-gai Council in 2018. The Planning Proposal has proceeded through Gateway Determination and will be placed on public exhibition in the first quarter of 2021. Following the public exhibition the Council will determine whether to proceed with the LEP amendment.

Application 3 for alterations and addition to DA 0134/2018 seeking approval for level 7 to added to be approved development.

  • This development application cannot be advanced until the height control has been amended. It is anticipated that this application will be advanced in the first quarter of 2021.

GOING FORWARD - WHAT TO EXPECT IN THE NEXT 6 MONTHS

Over the next 6 months you can expect to see the following planning matters being resolved for the New Rose Project:

  • Public exhibition of modified basement car parking plans - Target Date October 2020

    • In approving DA 0134/18 the Sydney North Planning Panel provided conditional development consent. Pursuant to Condition 48A of the Consent Instrument the Panel required that a minimum of 11 car parking spaces be provided for the Club. To comply with this provision, an amended basement plan will need to be submitted and publicly exhibited. To accommodate the additional parking spaces, the original basement layout has been modified and the area of excavation extended to under the 156 square metre parcel of council owned land at the Larkin Street frontage that will be sold to the Club.

  • The public exhibition of a Voluntary Planning Agreement addressing the acquisition of Council owned land at the Larkin Lane frontage - Target Date February 2021

    • The conditions of development consent for the New Rose Project provide for the sale of this land to the Club. Once the terms of the sale are agreed with the Council the transfer of the land is realised under a Voluntary Planning Agreement (VPA). The terms of reference for a VPA are established under the Environmental Planning and Assessment Act 1979.

    • The Council land parcel is important to the development, as it will form part of the basement car park. At ground level the land will not be built upon, it will be paved as a pedestrian pathway that connects to the Larkin Lane car park.
